Studies have shown that there may be a link between the use of Fosamax and osteonecrosis of the jaw, also known as "jaw death." Osteonecrosis is the destruction of bone tissue. The condition of jaw death may be triggered in the jaw by oral surgery or having teeth pulled. Osteonecrosis of the jaw can be extremely painful and may lead to additional complications, such as infection, breakdown of the jawbone, and ulcerations in the lining of the mouth. |

A jury in Atlantic County, N.J. this afternoon returned a $2.62 million verdict to Alabama resident Andy McCarrell against Nutley, N.J.-based pharmaceutical companies Hoffmann La-Roche Inc. and Roche Laborotories. Mr. McCarrell used Accutane for approximately four months in 1995 for the treatment of his acne. Over the next year, Mr. McCarrell began experiencing the symptoms of inflammatory bowel disease, which was later diagnosed as Crohn?s disease?a severe, debilitating, and permanent form of inflammatory bowel disease. Mr. McCarrell?s case was the first of approximately 400 inflammatory bowel disease cases pending in the New Jersey Superior Court in Atlantic City to reach trial. |

NEW YORK, March 12, 2007 ? A jury in Atlantic County, N.J. today returned verdicts, awarding $20 million in compensatory damages and $27.5 million in punitive damages to plaintiff Frederick "Mike" Humeston and his wife Mary against defendant Merck & Co. (NYSE: MRK) in the Vioxx-related personal injury trial entitled, Humeston v. Merck, as reported by the plaintiffs? trial counsel, Seeger Weiss LLP. The jury?s verdicts represent a total damages award against Merck of $47.5 million. |
