A purveyor of goods or services may be liable if it has exhibited any of the following practices:
- Misrepresenting the condition of a product if it is refurbished or used.
- Bait and switch.
- Misrepresenting a warranty, and/or failing to abide by a warranty.
- Representing that services, replacements, or repairs are needed if they are not.
- Providing a product or service of inferior quality or below the standard agreed to.
- Misrepresenting the origin of the goods or purveyor of the service.
- Misrepresenting the certifications or endorsements of a product.
- Any other conduct that encourages misunderstanding.
