A purveyor of goods or services may be liable if it has exhibited any of the following practices:
  • Misrepresenting the condition of a product if it is refurbished or used.
  • Bait and switch.
  • Misrepresenting a warranty, and/or failing to abide by a warranty.
  • Representing that services, replacements, or repairs are needed if they are not.
  • Providing a product or service of inferior quality or below the standard agreed to.
  • Misrepresenting the origin of the goods or purveyor of the service.
  • Misrepresenting the certifications or endorsements of a product.
  • Any other conduct that encourages misunderstanding.
