Medical Malpractice Injury
People in all professions make mistakes from time to time, and doctors and medical professionals are no exception. Each year, approximately 3,000 doctors are disciplined in the United States by their state medical boards for offenses ranging from negligence to criminal violation of law. A recent report from the Institute of Medicine cites two studies alleging that between 44,000 and 98,000 hospitalized Americans die every year because of medical negligence. The statistics set forth in this report account only for hospital patients and do not include deaths caused by negligent treatment at a doctor's private office. Including all deaths suffered as a result of medical malpractice, the numbers are staggering, leading many experts to the conclusion that medical negligence causes more deaths than car accidents or AIDS on a yearly basis and cost society as much as $29 billion in costs such as lost income, disability, and health care costs.
Medical Malpractice and Negligence
Malpractice is a term by the legal profession for professional negligence, and medical malpractice is the negligence of a doctor. Medical malpractice is the failure of a doctor to use reasonable care under the circumstances in the treatment and care that he or she provides to a patient, thereby deviating from the accepted standard of care. Physicians are not the only health care professionals that can be found to have committed medical malpractice. Medical malpractice is not limited to doctors or hospitals. Nurses, technicians, hospital workers, nursing home attendants and other professionals in the medical landscape also have a duty to use reasonable care in the medical treatment which they render to their patients and will be held liable for their failure to adhere to the accepted standard of care

Consultation with New York Medical Malpractice Lawyer
Most states, including New York, have set strict time limitations periods during which you can recover damages for personal injuries resulting from medical malpractice. While the statute of limitations for medical malpractice actions in the State of New York generally gives victims of medical malpractice 2 1/2 years from the date of the malpractice within which to commence a lawsuit, several exceptions to this rule apply which could either limit or enlarge the statutory period. For example, there is a requirement pursuant to the General Municipal Law requiring victims of medical malpractice at a New York City owned hospital to file a Notice of Claim with the appropriate City agency within 90 days from the date of the malpractice and a year and ninety days within which to commence a lawsuit. The failure to file your claim for medical malpractice in a timely manner pursuant to the applicable limitations period may forever bar you from bringing a claim. As such, a consultation with an experienced medical malpractice attorney in the early stages of your investigation is highly recommended in order to ensure that your claim is filed timely.
