Recent Mesothelioma Lawsuit Decision
The New Jersey Supreme Court has recently ruled that a premises owner owed a duty to the wife of a worker who was exposed to asbestos when the wife handled work clothing that was contaminated with asbestos dust. In the case of Olivo v. Owens-Illinois, Inc, the court opinion states "We hold that to the extent Exxon Mobil owed a duty to workers on its premises for the foreseeable risk of exposure to friable asbestos and asbestos dust, similarly, Exxon Mobil owed a duty to spouses handling the workers' unprotected work clothing based on the foreseeable risk of exposure from asbestos borne home on contaminated clothing."
In this important decision that could have a significant impact on potential asbestos lawsuits, the New Jersey Supreme Court ruled unanimously, 5-0, in favor of a Woodbury, New Jersey man, allowing him to pursue a wrongful death claim against Exxon Mobil on behalf of his wife, who died one year after being diagnosed with mesothelioma. Exxon Mobil was one of thirty-two defendants named in the wrongful death lawsuit, but was the only party not to settle. The complaint in the wrongful death case alleges that the wife developed mesothelioma because of her exposure to asbestos dust brought into the home on her husband's work clothes. The New Jersey man worked as a welder and steamfitter from 1947 until his retirement in 1984, frequently working with asbestos-containing materials. Among the locations where he worked with asbestos materials was the Exxon Mobil oil refinery in Paulsboro, New Jersey. As part of a daily routine, each night after he returned home from work, his wife would launder her husband's work clothing that had been contaminated with asbestos dust.
